R v Greaves & Others (Court of Appeal - January 2010)

On a renewed application following refusal by the single judge, Brian Lett Q.C. has persuaded the Court of Appeal to grant leave to appeal sentence in the case of R v Claude Greaves. The points of principle involved are whether a judge may pass a sentence on a money laundering count that exceeds the maximum sentence available for the precedent offence, and whether if there is no separate gravamen for the money laundering offence, a sentence may be consecutive to that for the antecedent offence. No date of hearing has yet been fixed.
