R v Ryan Campbell (Croydon Crown Court) August 2009

Road traffic expert Edward Culver defended the first prosecution for causing death by driving whilst uninsured. Despite the difficulty in challenging any element of this new offence, the judge acknowledged that no fault was required in the standard of driving involved, and that the fatal collision in this case was a genuine accident arising from an unfortunate set of circumstances. The sentence passed was significantly lower than the starting point prescribed in the published guidance.
