R v Hall and Lambert (Plymouth Crown Court) October 2010

This case concerned drunken gang violence. The victims were kicked whilst prone on the ground, following a pursuit across Plymouth town centre which culminated in a fight on the notorious Union Street. Both the pursuit and the fight were captured on extremely clear CCTV. As the comments attached to the news story attest, the case was unpleasant. Despite the prosecution opening the facts on the basis that the attack was weaponised (by virtue of the kicking with shod feet) and should therefore attract the highest sentencing bracket for assaults of its type, two of the three defendants escaped an immediate custodial sentence.
