R v Spears and McAllister 2009

Leave granted to appeal a confiscation order on the issue of abuse. The benefit is that the confiscation order acts as a fine and additionally as a disproportionate penalty under Art 1 to the First Protocol to the ECHR. This has been confirmed by the Court of Appeal recently. Instructing Solicitors also want Meyrick to do both appeals in this case.
